1
Introduction & Binding Agreement
These Terms and Conditions constitute a legally binding agreement between Melba Energy Pty Ltd ("Melba Energy", "we", "us", "our") and the customer ("you", "your", "client") named on the official quotation, assessment form, or installation agreement.
By requesting a quote, confirming an installation booking, or accepting an invoice, you acknowledge that you have read, understood, and agreed to be bound by these terms, as well as the statutory regulations governing the Victorian Energy Upgrades (VEU) scheme.
2
Products & Scope of Energy Upgrades
Melba Energy supplies and installs energy-efficient systems across Victoria, including:
- Reverse-Cycle Inverter Air Conditioners (Activity 28): Single-split, multi-split, and central ducted inverter heating and cooling systems.
- Heat Pump Hot Water Systems (Activity 1 & 3): High-COP ambient air-to-water heat pump cylinders replacing electric resistance tanks or gas storage units.
- Clean Energy Storage: Lithium Iron Phosphate (LiFePO4) solar home batteries and hybrid inverter systems.
- In-Home Displays (Activity 30): Zigbee/Bluetooth smart monitors paired with Victorian smart electricity meters.
All equipment supplied complies with Australian Standards (AS/NZS), Clean Energy Council (CEC) guidelines, and the Essential Services Commission (ESC) Register of Product Approvals.
3
Victorian Energy Upgrades (VEU) & VEEC Assignment
Where a quotation reflects an upfront point-of-sale discount under the Victorian Energy Upgrades program:
- Assignment of Certificates: Any assignment of rights to create Victorian Energy Efficiency Certificates (VEECs) must identify the accredited provider responsible for the discount in the relevant documentation. Melba Energy is not a VEU accredited provider. Confirm the provider, eligibility and discount before accepting a quotation.
- Declaration Signing: You agree to accurately complete and sign the mandatory VEU Consumer Nomination and Declaration forms on the day of installation.
- Audit Participation: The Essential Services Commission (ESC) randomly selects installations for independent telephone or physical audits. You agree to reasonably cooperate with ESC verification checks confirming the installation of your new system and the decommissioning of old equipment.
✓
Confirm Your Discount: Any applicable discount, conditions and remaining amount payable should be set out in your written quotation before work starts.
4
Quotations & Transparent Pricing
Every quote issued by Melba Energy provides complete itemization without hidden fees:
- Gross Retail Value: Full equipment cost and standard installation allowance.
- Government Rebate Deduction: Exact dollar value of eligible VEU/VEEC discounts credited at point of sale.
- Net Out-of-Pocket Total: The final balance payable by the customer upon completion.
- Non-Standard Works: If your property requires non-standard infrastructure (e.g., switchboard electrical upgrades, long pipe runs exceeding standard back-to-back limits, complex condensate pumps, or asbestos removal), these items will be clearly quoted and agreed upon in writing prior to commencing work.
5
Site Feasibility, Access & Safety
The client agrees to provide safe, unimpeded access to the installation area, electrical switchboards, water mains, and roof cavity on the agreed installation date.
In accordance with WorkSafe Victoria regulations, our certified installers reserve the right to halt work if unsafe site hazards (including deteriorated friable asbestos, severe structural instability, ungrounded wiring, or unrestrained animals) are encountered until the hazard is rectified by qualified contractors.
6
Licensed Trades & Compliance (COES & VBA)
All electrical installations are executed exclusively by certified A-Grade licensed electricians regulated by Energy Safe Victoria (ESV). All plumbing connections are completed by licensed Victorian Building Authority (VBA) plumbers.
Upon completion of all works, clients receive an official Certificate of Electrical Safety (COES) and/or a VBA Plumbing Compliance Certificate, validating legal compliance with Victorian safety regulations.
7
Mandatory Safe Decommissioning
Under the Victorian Energy Efficiency Target Regulations, receiving a point-of-sale VEU rebate strictly mandates that the replaced inefficient appliance (such as an old ducted gas furnace, space heater, or electric resistance water cylinder) be permanently disconnected and decommissioned.
Removal and recycling arrangements should be confirmed in your quotation. Where a VEU discount applies, the responsible accredited provider must confirm the required decommissioning and recycling records.
8
Warranties & Australian Consumer Law (ACL)
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
- Manufacturer Equipment Warranty: 5 to 7 years parts and compressor warranty on premier split systems (Daikin, Mitsubishi, Panasonic, Samsung) and up to 10 years on heat pump water cylinders.
- Workmanship Guarantee: Melba Energy provides a dedicated 5-year workmanship guarantee on all electrical and refrigeration installation labour, supported by our Melbourne service technicians.
9
